Information we collect

We collect only the information reasonably needed for the way you use the website:

• Enquiries: your name or account details, email address, WhatsApp details if you choose to contact us there, and the contents of your message.
• Ask Valentine: the questions you submit to the AI website assistant, its replies, a conversation reference and related technical information needed to operate and protect the service.
• Personalised orders: your name, email address, order type, instructions, recipient details, pronunciation guidance, creative preferences, confirmations and correspondence. Photo orders also include the photograph you upload and your selected character.
• Payment records: Stripe sends us a Checkout Session reference, payment status and transaction details needed to match and verify a personalised order or administer a voluntary support payment. Stripe processes your payment-card details; we do not receive or store your full card number.
• Newsletter: the name and email address you submit, your consent record and information needed to manage subscription or unsubscribe requests.
• Website use: hosting and security providers may process an IP address, browser or device information, timestamps and technical logs. Embedded players and external services may collect additional information as described below.

Some order details may be about another person, such as a song recipient or the person shown in a photograph. That information comes from the customer placing the order.

Why we use information

• Contract: to verify payment, review an order, create and deliver the personalised image or song, provide the included correction, and deal with service questions.
• Consent: to send the newsletter and, where separately agreed, to publish or feature a customer creation.
• Legitimate interests: to answer enquiries, operate and secure the website, prevent fraud or duplicate use of a payment, administer voluntary support payments, administer the business and establish or defend legal claims. We use this basis only where those interests are not overridden by your rights.
• Legal obligation: to keep tax, accounting and other records required by law and to respond to lawful requests.

Information required by the order form is needed to fulfil the order. If it is not provided, we may be unable to accept or complete the service.

Personalised creations and AI

Personalised photographs and songs are made using generative AI under Valentine Silverman’s creative direction. To create an order, relevant instructions and, for a photo order, the uploaded photograph may be processed by the AI and creative-service providers used for production. We use this material only to prepare, check, deliver and support the requested creation unless you give separate permission for another use.

You must have permission to provide photographs and personal details about other people. Please do not send sensitive personal information that is not needed for the creation. An adult with parental responsibility must place or approve an order involving a child.

We do not make solely automated decisions that have legal or similarly significant effects on customers. A customer creation is not published without separate permission. Tagging an official account may bring a post to our attention, but a tag by itself is not treated as permission for us to repost it.

Ask Valentine AI assistant

Ask Valentine is an AI assistant, not a human representative. Messages are sent securely through our website to OpenAI so the assistant can answer questions about Silverman Statue and the services described on this site. The assistant may identify that a question needs personal attention and direct you to our business email.

Please do not enter payment-card details, passwords, health information or other unnecessary sensitive information. AI answers can sometimes be incomplete or mistaken; contact us before relying on an answer about an order, payment, complaint, legal right or other important matter.

We use trusted providers where needed to operate the website and services:

• Stripe for Checkout and payment processing.
• Jotform for personalised-order forms, confirmations and photo uploads.
• Make.com to automate payment verification and order handling.
• Google services for secure business storage and order administration.
• Systeme.io to collect and manage newsletter subscriptions and send newsletter emails.
• OpenAI to operate the Ask Valentine website assistant and to support relevant AI-assisted creative work.
• Email, communications, website-hosting and security providers to deliver messages and keep the website available and protected.
• AI and creative-service providers used to produce the ordered image or song.

We disclose information only as needed for the relevant service, when required by law, or to protect legal rights. We do not sell personal information.

International processing

Some providers may process information outside the UK. Where UK data-protection law requires it, we use providers and arrangements that rely on a UK adequacy regulation or appropriate contractual and organisational safeguards. You can ask us for more information about the safeguards relevant to your information.

How long we keep information

• Uploaded photographs and working copies are normally deleted within 30 days after delivery.
• Order, payment, contract and accounting records are normally kept for up to six years from the end of the relevant company financial year, or longer where the law or an active dispute requires it.
• Enquiry and service correspondence is kept only for as long as reasonably needed to deal with the matter and any related legal claim.
• Newsletter details are kept while you remain subscribed. After you unsubscribe, we may keep the minimum information needed to record and respect that choice.
• Technical and security logs are kept according to the relevant provider’s retention period and only for as long as reasonably needed.

We may keep information for longer if required by law, a court, a regulator or the prevention or defence of legal claims.

Newsletter

We send newsletter emails only when you have actively subscribed or otherwise given valid permission. You can unsubscribe at any time by using the link in an email or contacting info@silvermanstatue.com. Withdrawing consent does not affect earlier lawful use of your information.

Cookies, embedded media and external sites

We do not currently operate our own advertising or audience-analytics service on this website. The site includes embedded YouTube and Spotify players. Those providers may receive technical information and may store or access cookies or similar technologies when their content loads or when you interact with it. The newsletter, Stripe Checkout, Jotform, WhatsApp, social, music and affiliate links open services operated by other organisations, whose privacy and cookie terms apply.

We will review this information and any consent controls if the website’s tracking or embedded services change.

Security

We use reasonable technical and organisational measures and reputable service providers to protect personal information. Access is limited to people and providers who need it for the purposes described above. No online service or transmission can be guaranteed completely secure, so please do not send unnecessary sensitive information.

Your data-protection rights

Depending on the circumstances, you may have the right to ask for access to, correction of, deletion of, restriction of, or a portable copy of your personal information. You may also object to processing based on legitimate interests.

You have an absolute right to object to direct marketing at any time. Where we rely on consent, you may withdraw it at any time.
